NFORMATION ON THE PROCESSING OF PERSONAL DATA PURSUANT TO ARTICLE 13 OF EU REGULATION 2016/679

MCF SHOPS SRL, (hereinafter referred to as "MCF") transcribes this Information Notice in order to make visitors to the website "www.blancmariclomilano.com" (hereinafter referred to as the "Site") aware of the policy adopted with regard to the protection of personal data, emphasising its commitment and attention with reference to the protection of the privacy of the same visitors. This information is provided only for the Site and not also for other websites that may be consulted by the user through links, in respect of which MCF cannot be held responsible with regard to the processing of personal data carried out therein. Pursuant to and for the purposes of EU Regulation 2016/679 MCF provides the following information.

Types of personal data processed through the Site

Connection and navigation data

The computer systems and software procedures used to operate this site acquire, during their normal operation, some personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes the IP addresses or domain names of the computers and terminals used by users, the URI/URL (Uniform Resource Identifier/Locator) notation addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server (successful, error, etc.) and other parameters relating to the operating system. ) and other parameters relating to the user's operating system and computer environment are collected for the sole purpose of obtaining anonymous statistical information on the use of the Site and to check its correct operation, and are deleted immediately after processing.

The optional, explicit and voluntary sending of messages to MCF's contact addresses entails the acquisition of the sender's contact data, necessary to reply, as well as all personal data included in the communication.

Registration data / use of Site services

No registration is required to access the Site; however, in some dedicated areas of the Site it is possible to register in order to access the services offered therein (newsletters, franchise applications, B2B portal for online shops, sending of CVs for job offers). In these areas, common personal and identification data may be requested, such as name, surname, address or other contact data, date of birth, data on the order and purchase process, tax data and other data for invoicing and delivery of products, data relating to CVs and motivational letters through the dedicated section of the Site.

Methods of data processing

The processing of your personal data will be mainly carried out with the aid of electronic means, including automated means, according to the methods and with the instruments suitable to guarantee the security and confidentiality of the data. In particular, all technical, IT, organisational, logistical and procedural security measures will be adopted, so that an adequate level of data protection is guaranteed, as required by law, allowing access only to persons authorised to process the data by the Data Controller or by the Managers appointed by the Data Controller. The information acquired and the methods of processing will be relevant and not excessive in relation to the type of services rendered. The data will also be managed and protected in environments whose access is under constant control. MCF stores personal data by means of servers mainly located within the European Economic Area, however, it reserves the right to use services located in non-EU countries, in which case the service providers are selected among those who provide adequate guarantees pursuant to articles 45 et seq. of the GDPR. With specific reference to the USA, the transfer of data is authorised under specific decisions of the European Union and the Data Protection Authority, in particular Decision 1250/2016 (Privacy Shield).

  1. Purposes and legal bases of the processing operations

    The processing operations carried out through the Site are carried out for the following purposes and in accordance with the conditions of lawfulness (or legal bases) indicated below with reference to each of these purposes

    a) to enable you to navigate our Site and to benefit from the services offered therein through the dedicated areas;

    b) to provide you with assistance where requested by you through our Sales Department and to respond to your request sent by telephone or email (see the "Contact Us" section);

    c) for the use of the shop-online area of the Site by customers and potential B2C customers for the purposes of consulting our catalogues and sending purchase orders for products;

    in all the above cases (points a) - e)) the legal basis of the processing is the performance of a contract and pre-contractual measures (Art. 6.1b GDPR);

    d) for the sending, through subscription in the "Subscribe to the newsletter" section of the Site, of commercial, promotional and informative communications in relation to the company and the products and services offered by it, the legal basis of the processing in question is your explicit consent (art. 6.1a GDPR) revocable at any time

    (e) to comply with obligations imposed by laws or regulations or orders from competent and police authorities. The legal basis for such processing is the need to fulfil a legal obligation (Art. 6.1 c GDPR).

    Nature of the provision of data and consequences if data are not provided

    The provision of data for the purposes set out in points a) to e) of Article 4 above is optional. However, since such processing is necessary to allow registration to the Site and/or the use of the services offered through the same, including the fulfilment of your specific requests, the shop-online service, the commercial affiliation, the possibility to evaluate your application for job offers and the receipt of newsletters on MCF products and services failure to provide the data in question, in whole or in part, will make it impossible to take advantage of the above-mentioned services and, in general, to proceed with the contractual relationship being established or entered into and/or to fulfil the obligations connected therewith.

    Failure to provide data for marketing purposes (point d, art. 4) will not have any consequence on the possibility to register to the Site and to use the services provided therein, but will only imply the impossibility for you respectively and to receive commercial material related to MCF products and services. For the purposes of point e) of art. 4 the conferment of data is compulsory by law.

    Recipients of data

    Users' personal data may be communicated to the following categories of recipients

    (a) external service providers to which MCF may turn to for the provision of professional, technical (e.g. hosting and technological maintenance of the Site) and organisational services functional to the management of the Site and the activities carried out therein, such as, for example, the management of the functions offered by the Site;

    (b) subjects (Judicial Authorities, police forces) who have access to personal data by virtue of regulatory or administrative measures

    (c) banking institutions and companies managing the national or international payment circuits through which payments for products are made once ordered through the Site

    (d) agencies/platforms for the automated marketing communications service;

    (e) couriers or forwarding agents in charge of delivering the products ordered through the Site;

  1. Periodo e luogo di conservazione dei dati personali

    MCF conserva i Suoi dati personali per il tempo strettamente necessario al perseguimento delle finalità sopra indicate nel rispetto degli obblighi civilistici e fiscali di conservazione e dei limiti previsti dalla legge. In particolare, MCF adotta i seguenti termini di conservazione.

    Richieste di contatto/reclami. I Suoi dati personali saranno conservati per il tempo necessario a evadere la richiesta.

    Account. Nel caso di cancellazione, esclusione o disabilitazione per mancato utilizzo del Suo account sul Sito, i Suoi dati saranno conservati per finalità amministrative per un periodo non superiore ad un trimestre, fatti salvi eventuali specifici obblighi di legge sulla conservazione di documentazione contabile o per finalità di pubblica sicurezza. In tali casi, sarà garantita la cancellazione dei dati anche da parte dei responsabili nominati cui gli stessi siano stati eventualmente comunicati.

    Servizi di vendita. Salvo quanto sopra indicato, i dati dell’utente saranno trattati e conservati per tutta la durata del rapporto contrattuale e, successivamente, per il tempo massimo previsto dalle disposizioni di legge applicabili in materia fiscale, contabile e di prescrizione dei diritti e/o decadenza dell’azione e, in generale, per l’esercizio/difesa dei diritti di MCF nelle vertenze promosse da pubbliche autorità, soggetti /enti pubblici e soggetti privati.

    Marketing. Con specifico riferimento ai Suoi dati personali trattati per finalità di invio di comunicazioni marketing saranno conservati per il periodo di tempo consentito dalla legge e dalle prescrizioni del Garante per la Protezione dei Dati Personali e, dunque, per un periodo non superiore a 24 mesi a decorrere dalla registrazione dei dati in occasione della prestazione originaria del consenso e/o dal relativo rinnovo.

    Diritti degli interessati

    Ai sensi degli artt. 15-22 del Regolamento UE 2016/679 a Lei, in qualità di interessato, vengono riconosciuti i seguenti di diritti:

    Diritto di Accesso: l’interessato, ai sensi dell’art. 15, ha diritto di ottenere la conferma che sia in corso un trattamento di dati personali che lo riguardano e, se del caso, di ottenerne copia. Ha inoltre il diritto di ottenere l’accesso ai dati personali che lo riguardano e a ulteriori informazioni quali la finalità del trattamento, le categorie di destinatari, il periodo di conservazione dei dati e i diritti esercitabili.

    Diritto di rettifica: l’interessato, ai sensi dell’art. 16, ha diritto di ottenere la rettifica dei dati personali inesatti che lo riguardano o l’integrazione degli stessi.

    Diritto alla cancellazione: l’interessato ha diritto di ottenere la cancellazione dei dati personali che lo riguardano, senza ingiustificato ritardo, qualora sussista una dei motivi previsti dall’art. 17.

    Diritto di limitazione di trattamento: l’interessato ha diritto, nei casi previsti dall’art. 18 del Regolamento 2016/679, di ottenere la limitazione del trattamento.

    Diritto alla portabilità dei dati: l’interessato ha diritto di ricevere in un formato strutturato, di uso comune e leggibile da dispositivo automatico, i dati personali che lo riguardano e ha il diritto di trasmettere tali dati a un altro titolare senza impedimento, secondo quanto previsto dall’art. 20 del Regolamento 2016/679;

    Diritto di opposizione al trattamento: l’interessato ha diritto di opporsi al trattamento dei dati personali che lo riguardano secondo quanto previsto dall’art. 21 del Regolamento 2016/679.

    Reclamo: l’interessato ha altresì diritto ex art. 77 del Regolamento di proporre reclamo all'Autorità Garante per il trattamento dei dati personali (www.garanteprivacy.it)
